Abstract

This paper aims to clarify the foundations for military intervention for human protection purposes on the occasion of the responsibility to protect, backing it self in the United Nations Charter, the Rome Statute, the A/RES/60/1 Resolution: Final Document of the 2005 World Summit, among others. This research is made on a documentary - descriptive type with a bibliographic design, with an interpretation of legal texts with the art of legal interpretation. We conclude that the responsibil ity to protect the principle of non- violent nonintervention and its application is not limited to the military in tervention, but rather extends to the prevention and preservation of peace and human security. Each case as signed to the Security Council will al ways be isolated and considered in isolation and should be taken individu ally. This is so, be cause of the different risk factors surrounding conflicts and the consummation of the heinous crimes.
