Gender Violence and Violence against Women in the Venezuelan Legal Context

Abstract

The objective of the study is to distinguish the terms gender violence and violence against women, avoiding being in the reductionist tendencies of the object of study, considering the violence as a phenomenon that is present in all the conditions of human life. Under the methodology of bibliographic design of legal documentary type at an analytical level, it is concluded that violence affects the sufferer equally, by virtue of which, it cannot be associated with a gender, that is to say, only to the one that the man makes against the woman, therefore, the affirmative actions that the State has established, through the Organic Law on the Right of Women to a Life Free of Violence (2007) to deal with this situation, come up from a vision very restricted or limited of the concept, which affects the right to equality and human dignity.
